Acceptance of these terms

By accessing this website, submitting the seller intake form, or purchasing a ListSimple package, you agree to these terms and to the disclosures below. If you do not agree, please do not use the site or purchase a package. These terms are an agreement between you, the seller, and Sweet Home Realty, LLC (“Sweet Home Realty,” “we,” or “us”).

Limited-service brokerage program

ListSimple is a limited-service brokerage program offered by Sweet Home Realty, LLC. It is not full-service listing representation unless the seller upgrades and signs the required documents. Unless upgraded, the seller remains responsible for the parts of the sale not included in the selected package.

Fees and payment

ListSimple package fees are shown on the site and are charged as a one-time payment at checkout. Payment is processed securely by Stripe; card details are entered directly with Stripe and are not stored by Sweet Home Realty. Each package covers a listing term of up to six months from the date your listing goes live, subject to these terms and your listing documents. ListSimple does not charge an additional percentage-based or transaction fee at closing. Package fees do not include buyer-broker compensation, seller concessions, title or closing charges, taxes, government or recording charges, inspections, appraisals, photography (except where a package states otherwise), legal fees for services outside any specifically offered limited consultation, or other third-party transaction expenses.

Package upgrades

During the active ListSimple listing term, a seller may upgrade from Basic to Plus or Pro, or from Plus to Pro, by paying the difference between the then-applicable package prices, subject to service availability and any third-party services already performed or scheduled. The upgraded package does not restart the original six-month listing term unless Sweet Home Realty agrees otherwise in writing.

Cancellation and refunds

You may cancel and request a refund of your package fee at any time before your listing goes live on the MLS. Once your listing has been published to the MLS, the package fee is non-refundable, because the listing preparation and submission work has been completed. Any third-party costs already incurred on your behalf (for example, photography that has been scheduled or completed) may be deducted from a refund. To cancel, contact Sweet Home Realty using the information below. This policy applies to the ListSimple package fee and does not change any separate agreement you sign.

Your responsibilities as the seller

You are responsible for providing accurate, complete, and lawful information about the property and your authority to sell it, including ownership, occupancy, and any known liens, violations, permit issues, or association matters. Unless included in your selected package or a signed upgrade, you remain responsible for pricing decisions, showings, negotiations, offers, legally required disclosures, and coordinating your transaction to closing. You are responsible for ensuring your listing content complies with fair housing and other applicable laws.

Brokerage and legal services are distinct

Listing syndication and IDX exposure occur where available through MLS and broker feeds. Third-party website display is not guaranteed and may depend on MLS settings, broker feeds, platform rules, seller instructions, and other factors.

Buyer-broker compensation

Buyer-broker compensation, if any, cannot be offered or advertised through the MLS. Any request for seller payment toward buyer-side brokerage compensation must be handled outside the MLS and/or through the purchase offer and negotiation process as permitted.

Upgrade credit limitations

The upgrade credit has no cash value, is nonrefundable, is not transferable, and may only be applied toward Sweet Home Realty's listing-side brokerage commission if the seller upgrades to a full-service Sweet Home Realty listing during the active ListSimple listing term. The credit does not apply to buyer-broker compensation, seller concessions, legal fees, title fees, recording fees, government charges, third-party vendor fees, photography fees, inspection fees, appraisal fees, repairs, or closing costs.

Target launch timeline

The target listing launch is within 24 hours after payment, completed intake, signed listing documents, complete photos/media, seller approvals, and broker review. Timing may vary based on missing information, MLS requirements, property details, or compliance review.

Limitation of liability

Sweet Home Realty provides limited-service brokerage services as described in your selected package. To the fullest extent permitted by law, Sweet Home Realty is not responsible for outcomes outside its control, including whether your property sells, the final sale price, the conduct of buyers or other agents, third-party website display, or delays caused by incomplete information. Nothing in these terms limits any liability that cannot be limited under Florida law or under the obligations of a licensed Florida real estate broker.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these terms or the ListSimple service will be handled in the state or federal courts located in Miami-Dade County, Florida, and you consent to that venue.

Changes to these terms

We may update these terms from time to time. The version posted on this page at the time of your purchase applies to that purchase. If you continue to use the site after updated terms are posted, you accept the updated terms.
